Terms of Service

These Terms of Service ("Terms") govern your use of the JUMPCAST website at jumpcast.app and the JUMPCAST membership (together, the "Service"), operated by JUMPCAST ("we", "us", "our"). JUMPCAST is a paid, invite-only membership that gives access to a media entertainment community on Discord. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and have reached the age of majority in the country where you live (or have the consent of a parent or guardian where the law allows it), and you must be able to enter into a binding agreement. You must also meet the minimum age required by Discord's terms in your country.

2. Invitations and accounts

  • Membership is by invitation only. Invitation links are personal and may not be sold, traded, or published.
  • Give accurate information when you create your account and keep your email address current.
  • Keep your password and any two-factor authentication method secure. You are responsible for activity under your account.
  • An account is for one person. Sharing an account, a membership, or its access with anyone else is not allowed.
  • Each membership may be linked to one Discord account. Once linked, the link is permanent; we change it only at your request after verifying your identity.

3. Memberships, trials, and billing

  • Paid memberships are subscriptions billed in US dollars (USD) in advance for each billing period by our payment processor, Stripe. Your bank may add currency conversion or foreign transaction fees.
  • Automatic renewal. Paid memberships renew automatically at the end of each period at the price shown when you subscribed until you cancel. We will tell you in advance about any price change, and you may cancel before it takes effect.
  • Free trials. Some invitations include a free trial. If a trial does not require payment details, it simply ends unless you add a payment method. If you add a payment method, you will be charged when the trial ends unless you cancel before then. We send reminders before a trial ends.
  • Free access. Some invitations grant free access. Free access may have an end date shown in your account, and we may end or change free access with reasonable notice.
  • Cancellation. You can cancel at any time from your account page. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Refunds are described in our Refund Policy.
  • Prices may include or exclude taxes depending on where you live; any taxes that apply are shown at checkout.

4. Missed payments

If a payment fails, we will notify you and retry the payment. If it is still unpaid after a grace period, your member role in the Discord community is removed. Your account is kept, and access is restored as soon as the outstanding payment succeeds. We may close memberships that stay unpaid for an extended time.

5. Discord

The community runs on Discord, a service operated by a third party. Your use of Discord is governed by Discord's own terms and policies, which apply in addition to these Terms. We are not responsible for Discord's availability or conduct, and a suspension of your Discord account by Discord may affect your access to the community.

6. Acceptable use

You agree not to:

  • harass, threaten, or discriminate against others, or post hateful, sexually explicit, or illegal content;
  • share, sell, or distribute copyrighted material you do not have the right to share, including pirated media;
  • share your account, invitation, or member access, or help anyone get around our access controls;
  • scrape, attack, probe, or interfere with the Service or its security;
  • impersonate others or misrepresent your identity or affiliation;
  • use the Service for spam, fraud, or any unlawful purpose.

Community rules posted in the Discord server also apply.

7. Content and intellectual property

The Service, including the website, its design, and the JUMPCAST name, belongs to us or our licensors. You keep ownership of what you post in the community. By posting, you allow us to host, display, and moderate that content as needed to run the community. We may remove content that breaks these Terms or community rules.

8. Suspension and termination

You may close your account at any time by contacting us. We may suspend or end your membership if you seriously or repeatedly break these Terms, if we are required to by law, or if we stop offering the Service. Where reasonable, we will give you notice and a chance to respond first. If we end a paid membership for reasons other than your breach, we will refund any prepaid, unused period.

9. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. If a change to these Terms materially affects you, we will give you at least 30 days' notice by email or on the website before it takes effect. If you do not agree, you may cancel before the change applies.

10. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available." We work to keep it running smoothly, but we do not promise it will always be available, uninterrupted, or error-free, and we are not responsible for content posted by other members.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.

12. Your consumer rights

Nothing in these Terms limits or excludes any rights you have under the mandatory consumer protection laws of the country where you live, including in the European Union and European Economic Area, the United Kingdom, Australia, and elsewhere. Where these Terms conflict with those laws, those laws apply.

13. Disputes and governing law

If you have a problem, please contact us first at support@jumpcast.app; most issues can be resolved quickly that way. If you use the Service as a consumer, these Terms are governed by the laws of the country where you have your habitual residence, and you may bring a claim in the courts of that country. Nothing in these Terms requires you to use arbitration or prevents you from joining a collective or class proceeding where the law allows it. EU consumers may also use their national consumer dispute resolution bodies.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your membership; we may transfer our rights and obligations to a successor that continues the Service on the same terms.
